General Terms and Conditions (GTC) of Berlinliner / Jhonatan Mendoza
1. Scope of Application
The courses, workshops, and groups of Berlinliner take place exclusively on the basis of the following terms and conditions. Deviations from these conditions are only valid if they are explicitly confirmed in writing by Berlinliner.

2. Registration and Right of Withdrawal
Our inquiry forms are non-binding and subject to change. The participant receives the offer electronically via email, and the confirmation is also sent electronically. The booking system thus replaces written correspondence, meaning the participant registers bindingly for the specified course on the specified date via the electronic confirmation of participation. By registering, the participant accepts the GTC of Berlinliner and binds themselves to participate in the agreed course and pay the course fees. Note on the right of withdrawal: Since the courses are services related to leisure activities for which a specific date or period is provided, there is no statutory right of withdrawal for consumers under Section 312g (2) No. 9 BGB (German Civil Code). Only the cancellation policy set out in Section 7 applies. Registrations of minors must be confirmed by their legal guardian(s).

3. Main Obligations of Berlinliner
By confirming the participant's registration, Berlinliner commits to properly conducting the booked course. The required equipment (skates and protective gear) for the course must be provided by the participant, unless a paid equipment rental was booked and confirmed in advance through Berlinliner.

4. Main Obligations of the Participant Participants are obligated to pay the course fee. Every participant is obligated to wear the prescribed protective equipment. Furthermore, every participant is obligated to follow the instructions of the teaching staff immediately, to treat any provided rental equipment with care, and to participate in the lessons in such a way that the other participants are able to participate undisturbed. In the event of an infringement, the instructor is entitled to exclude participants from attending further classes without the participant being entitled to any refund claims.

5. Prices Our prices are to be paid without deduction. Course fees must be received by us no later than the start of the course. If such fees are not received on time, the right to participate in the booked course is forfeited, without prejudice to Berlinliner's right to demand the course fees.

6. Liability and Disclaimer Participation in the courses is at the participant's own risk. Berlinliner's liability for breaches of contractual obligations and in tort is limited to intent and gross negligence. This does not apply to injury to life, body, and health of the participant. Berlinliner is not liable for material and financial damage caused by slight negligence. In particular, Berlinliner is not liable for accidents and their consequences if they are caused by incorrect behavior, defective personal equipment, or failure to follow the instructions of the instructor.

7. Right of Cancellation & Termination The registered participant is entitled to cancel their registration free of charge up to 24 hours before the course begins. For later cancellations or unannounced non-attendance, the full course fee is due. Non-attendance must be reported immediately upon becoming aware of the inability to attend. Group courses are booked as a complete package. If a class cannot take place due to force majeure or unsuitable weather (precipitation/rain), Berlinliner will provide an alternative date if possible. If an individual session of a booked group course package has to be canceled by Berlinliner due to weather and cannot be made up, the fee for that specific session will be refunded proportionally. All booked courses are valid for six months from the date of receipt of payment.

8. Practical Instruction and Health By registering, the participant confirms that they are physically fit and capable of practicing the sport of inline skating. Berlinliner determines the training location. The location will be announced in good time before the start of the course. Any type of skate instruction is weather-dependent. Traveling to the practice area is entirely the participant's responsibility. On the premises, the skate instructor's instructions must be followed strictly and immediately. If an instruction is not followed and damage results from this, the participant is liable. If a participant intentionally or through gross negligence causes damage to the rental equipment, they are fully liable to Berlinliner. Participants are required to wear weather-appropriate, sporty clothing.

9. Final Provisions Berlinliner reserves the right to conclude teaching contracts via third parties (e.g., agencies). The place of performance for all obligations is the respective location in Berlin. Should a provision of these General Terms and Conditions be invalid or void, this shall not affect the validity of the remaining provisions. There are no oral collateral agreements; any further changes must be in writing.
